9. Consumer Guarantees
Nothing in these Terms of Sale is intended to limit or replace any rights you, as a consumer have under the Trade Practices Act 1974, provided that if you are acquiring, or hold yourself out as acquiring, Products and Services for the purposes of a business in terms of the Act, the provisions of the Act will not apply and you will not assert or attempt to assert any rights or claims against Bose under the provisions of the Act.

You agree to indemnify Bose and Bose's relevant suppliers, licensors and agents in respect of any loss, damage, cost or expense (including reasonable enforcement costs, whether incurred on a solicitor and own client base or otherwise) suffered or incurred by Bose as a result of any inaccurate or incomplete information provided by you to Bose or any breach by you of any of your obligations under these Terms of Use (including any acts or omissions of your employer, contractors or agents).

Subject to the Privacy Policy, any communication or material transmitted to the Site by electronic mail or otherwise will be treated as non-confidential and non-proprietary.
